Terms and Conditions
Please read these terms and conditions of engagement with Goodchap Landscaping. In accepting a contract with Goodchap Landscaping you are agreeing to comply with and be bound by the following terms and conditions and govern Goodchap Landscaping's relationship with you in relation to the agreement/contract/work order.
In engaging Goodchap Landscaping, you signify your acceptance of these terms and conditions. For the purposes of these terms and conditions, “Us”, “Our” and “We” refers to Goodchap Landscaping and “You” and “Your” refers to you, the client or visitor.
Amendment of terms
We reserve the right to change, modify, add or remove portions of these terms at any time. Please check these terms regularly to ensure you are aware of any changes. We will endeavour to highlight any significant or substantive changes to you where possible. If you choose to engage in a contract/agreement with Goodchap Landscaping we will regard that use as conclusive evidence of your agreement and acceptance that these terms govern your and Goodchap Landscaping's rights and obligations to each other.
Agreement Terms
1. Deposit - 10% of total (if total under $20 000) or 20% of total (if total over $20 000) is to be paid at time of acceptance of quote to ensure booking of service. Deposit will be required for work to commence. Deposit is only refundable if materials are not bought prior to commencement of start date. In such case only part payment will be given back. Payment of materials may be required ahead of commencement date.
2. Cancellation of service to be provided to Goodchap Landscaping in writing one week before scheduled to commence.
3. Total settlement of payment is to be within 7 days of the final day of service unless otherwise agreed in writing.
4. All quotations, except for price, are valid for acceptance for thirty (30) days unless otherwise specified.
5. This quote does not include excavation into subterranean rock and the necessity to excavate in such conditions may alter charges quoted above.
6. Prices are subject to market increases and/or errors.
7. All care will be taken but no responsibility accepted for damage (or cost involved with) any underground hazards, obstructions or services that may not be known to Goodchap Landscaping in writing or apparent on visual inspection. This may include, but is not limited to, overhead lines, underground pipes, water mains, concrete driveways or pathways. Specific hazard locations should be provided by the customer prior to commencement of works.
8. All workmanship guaranteed for 12 months.
9. Variations are payable on the day of the variation and non payment of these variations may result in ceasing landscaping works.
10. Customer satisfaction of project progress and query clarification if applicable is verified as each stage payment is made.
11. In the event of dissatisfaction, customer should notify Goodchap Landscaping immediately to ensure that rectification is possible during works.
12. Goodchap Landscaping reserve the right to rectify issues raised during projects by either party specified on contract. Contracts remain valid during mediation processes and third party rectifications will invalidate open contracts if unapproved in writing by Goodchap landscaping.
13. Until payment in full is made on completion of service, all alterations and supplies provided by Goodchap Landscaping remains its property to be redeemed or altered from client property at its discretion without written or verbal notification.
14. The customer shall not be entitled to set off against, or deduct from the price, any sums owed or claimed to be owed to the customer by Goodchap Landscaping nor to withhold payment of any invoice because part of that invoice is in dispute.
15. Commencement and completion dates are subject to weather conditions and other unforseen delays. Your understanding in these instances is appreciated.
16. Neither party shall be liable for any default due to any act of God, war, terrorism, strike, lock-out, industrial action, fire, flood, storm or other event beyond the reasonable control of either party.
17. On completion of the job, ongoing maintenance, including plants and lawn, will be in the care of the customer and will require regular attention until established
